These General Terms and Conditions set out the rules and provisions for the sale of products and services by Carpe Ice. By making a purchase through our website or entering into a contract with us, you agree to these terms.

Article 1: Definitions

In these terms, the following definitions apply:
1. Cooling-off period: the period within which the consumer can exercise the right of withdrawal.
2. Consumer: a natural person who is not acting in the course of a profession or business and who enters into a distance contract with the trader.
3. Day: calendar day.
4. Continuing performance contract: a distance contract for a series of products and/or services where the delivery and/or purchase obligations are spread over time.
5. Durable medium: any means that enables the consumer or trader to store information in a way that allows future reference and unchanged reproduction.
6. Right of withdrawal: the consumer's option to cancel the distance contract within the cooling-off period.
7. Model form: the withdrawal form that Carpe Ice makes available.
8. Trader: the natural or legal person who offers products and/or services to consumers at a distance.
9. Distance contract: a contract concluded using one or more means of distance communication.
10. Means of distance communication: any means that can be used to conclude a contract without the consumer and trader being in the same place at the same time.
11. General Terms and Conditions: these general terms and conditions of Carpe Ice.

Article 2: Identity of the Trader

Article 3: Applicability

1. These general terms and conditions apply to every offer from Carpe Ice and to every distance contract concluded between Carpe Ice and the consumer.
2. These terms are made available to the consumer before the contract is concluded. If this is not possible, we will indicate where they can be viewed or send them free of charge on request.
3. If the contract is concluded electronically, these terms can be provided in a way that allows them to be easily stored on a durable medium.
4. If specific terms also apply in addition to these terms, the consumer may, in the event of a conflict, rely on the provision that is most favorable to them.

Article 4: The Offer

The offer from Carpe Ice is non-binding and may be changed at any time. All descriptions and images are shown as accurately as possible.

Article 5: The Contract

The contract is concluded as soon as the consumer accepts the offer and meets the stated conditions. Carpe Ice confirms receipt electronically.

Article 6: Right of Withdrawal

The consumer has the right to cancel the contract without giving any reason within 14 days of receiving the product.

Article 7: Costs in the Event of Withdrawal

The consumer bears the cost of return shipping. Refunds are made within 14 days of receipt of the returned product.

Article 8: Exclusion of the Right of Withdrawal

For certain products, such as earrings or personalized items, the right of withdrawal does not apply for hygiene reasons.

Article 9: The Price

All prices include VAT. Carpe Ice reserves the right to adjust prices if tax rates or legislation change.

Article 10: Conformity and Warranty

Carpe Ice guarantees that the products comply with the contract and with reasonable expectations. Your statutory rights remain unaffected.

Article 11: Delivery and Performance

Orders are carried out with care within 30 days, unless otherwise agreed. If a product is unavailable, an alternative or a refund will be offered.

Article 12: Term, Cancellation and Renewal

The consumer may cancel ongoing contracts at any time with one month's notice. Automatic renewal is not permitted without consent.

Article 13: Payment

Payment must be made within 7 business days of confirmation of the contract, unless otherwise agreed.

Article 14: Complaints Procedure

Complaints must be reported within 2 months of discovery. Carpe Ice responds within 14 days and aims for a fair solution.

Article 15: Disputes

Contracts with Carpe Ice are governed exclusively by Dutch law. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.

Article 16: Additional or Deviating Provisions

Additional provisions may not be to the consumer's disadvantage and must be recorded in writing.
