These General Terms and Conditions describe the rules and provisions for the sale of products and services by Carpe Ice. By making a purchase through our website or entering into an agreement with us, you agree to these terms.
Article 1 – Definitions
In these terms, the following definitions apply:
1. Cooling-off period: the period within which the consumer can exercise the right of withdrawal.
2. Consumer: the natural person who is not acting for purposes relating to trade, business, craft, or profession and who enters into a distance contract with the trader.
3. Day: calendar day.
4. Continuing performance contract: a distance contract relating to a series of products and/or services for which the delivery and/or purchase obligations are spread over time.
5. Durable data carrier: any medium that enables the consumer or trader to store information in a way that allows future consultation and unchanged reproduction.
6. Right of withdrawal: the possibility for the consumer to dissolve the distance contract within the cooling-off period.
7. Model form: the withdrawal form made available by Carpe Ice.
8. Trader: the natural or legal person who offers products and/or services to consumers at a distance.
9. Distance contract: a contract concluded by making exclusive use of one or more means of distance communication.
10. Means of distance communication: means that can be used to conclude a contract without the consumer and trader being simultaneously present.
11. General Terms and Conditions: these general terms and conditions of Carpe Ice.
Article 2 – Identity of the Trader

Article 3 – Applicability
1. These general terms and conditions apply to every offer from Carpe Ice and to every distance contract concluded between Carpe Ice and the consumer.
2. Prior to the conclusion of the contract, these terms are made available to the consumer. If this is not reasonably possible, it will be indicated where they can be consulted or that they will be provided free of charge upon request.
3. If the contract is concluded electronically, these terms may be provided in such a way that they can be easily stored on a durable data carrier.
4. If, in addition to these terms, specific terms also apply, the consumer may, in the event of conflicting provisions, invoke the provision that is most favorable to the consumer.
Article 4 – The Offer
Carpe Ice’s offer is non-binding and may be changed at any time. All descriptions and images are displayed as accurately as possible.
Article 5 – The Contract
The contract is concluded as soon as the consumer accepts the offer and meets the stipulated conditions. Carpe Ice confirms receipt electronically.
Article 6 – Right of Withdrawal
The consumer has the right to dissolve the contract without giving reasons within 14 days after receiving the product.
Article 7 – Costs in the Event of Withdrawal
The consumer bears the cost of returning the goods. Refunds are made within 14 days after receipt of the returned product.
Article 8 – Exclusion of the Right of Withdrawal
For certain products, such as earrings or personalized items, the right of withdrawal does not apply for hygiene reasons.
Article 9 – The Price
All prices include VAT. Carpe Ice reserves the right to adjust prices in the event of changes in tax rates or legislation.
Article 10 – Conformity and Warranty
Carpe Ice guarantees that the products comply with the contract and reasonable expectations. Statutory rights remain unaffected.
Article 11 – Delivery and Performance
Orders are carried out with due care within 30 days, unless otherwise agreed. In the event of unavailability, an alternative or a refund will be offered.
Article 12 – Term, Termination, and Renewal
The consumer may terminate ongoing contracts at any time with a notice period of one month. Tacit renewal is not permitted without consent.
Article 13 – Payment
Payment must be made within 7 working days after confirmation of the contract, unless otherwise agreed.
Article 14 – Complaints Procedure
Complaints must be reported within 2 months after discovery. Carpe Ice responds within 14 days and strives for a fair resolution.
Article 15 – Disputes
Only Dutch law applies to contracts with Carpe Ice. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.
Article 16 – Additional or Deviating Provisions
Additional provisions may not be to the detriment of the consumer and must be laid down in writing.
